Privacy Policy
INELEGANT SOLUTIONS, LLC (“Company,” “we,” “us,” or “our”) provides Beast Mode Buddies, a gamification app for sales professionals (the “Service”). This Privacy Policy explains what information we collect, how we use and share it, and the choices available to you. It applies to our website, app, and related services. It does not apply to third-party sites or services we link to or integrate with, including your CRM provider, which have their own privacy policies.
By using the Service, you agree to the collection and use of information as described in this Policy.
1. Information We Collect
1.1 Information you provide directly
- Account information: name, email address, phone number, job title/role, brokerage or organization name, and login credentials.
- Communications with us: if you contact support or provide feedback, we keep a record of that correspondence.
1.2 Information from your connected CRM
When you connect a CRM account, we access communication metadata about your outreach activity in order to power the Service’s gamification features. This includes, for example:
- The fact that a call, text, or email occurred;
- Timestamp, direction (inbound/outbound), and duration of the communication;
- The identifier of the associated contact/lead record in your CRM (e.g., a contact ID or name), so we can attribute activity to your outreach;
- Outcome/status fields your CRM may track for that communication (e.g., “call logged,” “meeting scheduled”), where available via the CRM’s API.
What we do not collect: We do not collect or store the content of your communications — we do not access call recordings, voicemail audio, call transcripts, text message bodies, or email body content. We only read metadata describing that an outreach event occurred, as made available through your CRM’s API.
We access only the CRM data fields necessary to support the Service’s features, based on the permissions you (or your organization’s CRM administrator) grant when connecting your account.
1.3 Information collected automatically
- Usage data: features used, in-app actions (e.g., pet-feeding events, achievements), session length, pages/screens viewed, and general engagement patterns with the Service.
- Device and log data: IP address, device type, operating system, browser type, and similar technical data, typically collected automatically by standard app/web infrastructure and analytics tools.
- Cookies and similar technologies: we may use cookies or local storage to keep you logged in, remember preferences, and understand usage of the Service.
2. How We Use Information
We use the information described above to:
- Provide, operate, and maintain the Service, including calculating gamification metrics (e.g., “feeding” your virtual pet) based on your CRM outreach metadata;
- Create and manage your account;
- Communicate with you about the Service, including updates, security alerts, and support messages;
- Monitor and analyze usage and trends to improve the Service’s features and performance;
- Detect, investigate, and prevent fraudulent, unauthorized, or illegal activity;
- Comply with legal obligations and enforce our Terms of Service;
- Understand engagement with the Service and, using aggregated or de-identified usage and metadata trends (such as overall call/text volume patterns or app engagement levels), inform and market other products and services offered by Company. We do not use the content of your communications for this purpose, because we do not collect it, and this use is limited to metadata and usage patterns as described in this Policy.
3. We Do Not Sell or Lease Your Data
We do not sell, rent, or lease your personal information or your CRM communication metadata to third parties, and we do not have any current plans to do so. If this ever changes, we will update this Policy and, where required by law (e.g., under the CCPA/CPRA), provide you with the ability to opt out before any such sale occurs.
4. How We Share Information
We do not share your personal information except as described here:
- Service providers: We share information with third-party vendors who perform services on our behalf, such as cloud hosting, analytics, customer support, and payment processing (if applicable). These providers are contractually restricted from using your information for any purpose other than providing services to us.
- Your CRM provider: To enable the integration, information flows between the Service and your connected CRM platform in accordance with the permissions you grant. That platform’s own privacy practices govern its handling of your data.
- Your organization/brokerage: If your account was provisioned by, or is associated with, an employer or brokerage, we may share account and usage information with authorized administrators of that organization (e.g., team leaderboards or usage summaries), consistent with how the Service is configured for your organization.
- Legal and safety reasons: We may disclose information if required by law, regulation, legal process, or governmental request, or where we believe disclosure is necessary to protect the rights, property, or safety of Company, our users, or others.
- Business transfers: If Company is involved in a merger, acquisition, financing, or sale of assets, your information may be transferred as part of that transaction, subject to this Policy or a successor policy.
- With your consent: We may share information for other purposes with your consent.
5. Data About Your Clients and Contacts
Because the Service reads metadata about your outreach to your own clients and leads from your CRM (such as contact identifiers tied to communication events), we may process limited information about individuals who are not Service users themselves (your clients/contacts). We process this information solely to attribute and measure your outreach activity for gamification purposes, and we do not use it to contact your clients directly, market to them, or build independent profiles about them. You are responsible for ensuring you have the necessary rights and permissions (including under your brokerage’s policies and applicable law) to connect your CRM and permit this processing.
6. Data Retention
We retain account information and CRM communication metadata for as long as your account is active, and for a reasonable period afterward as needed to comply with legal obligations, resolve disputes, and enforce our agreements. You may request deletion of your account and associated data as described in Section 8 below.
7. Security
We use reasonable administrative, technical, and physical safeguards designed to protect your information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
8. Your Choices and Rights
- Access/update: You can access and update certain account information directly within the Service.
- Disconnect your CRM: You can revoke our access to your CRM at any time via your account settings or your CRM provider’s permission controls.
- Deletion: You may request deletion of your account and associated personal information by contacting us at wilbee@inelegant.solutions. We will honor such requests subject to legitimate business or legal retention needs.
- Marketing communications: You can opt out of promotional emails by using the unsubscribe link in those emails. You may still receive transactional or service-related messages.
- State privacy law rights: Depending on where you live, you may have additional rights under state privacy laws (such as the California Consumer Privacy Act/CPRA, or similar laws in Virginia, Colorado, Connecticut, Utah, and other states), including the right to know what personal information we collect about you, request access to or a copy of it, request correction or deletion, and be free from discrimination for exercising these rights. As stated in Section 3, we do not sell personal information. You (or, where permitted, an authorized agent) may exercise these rights by contacting us at wilbee@inelegant.solutions. We may need to verify your identity before fulfilling certain requests.
9. Children’s Privacy
The Service is intended for business use by adults and is not directed to individuals under 18. We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, contact us at wilbee@inelegant.solutions and we will take appropriate steps to delete it.
10. International Users
The Service is designed for use in the United States. If you access the Service from outside the United States, your information will be transferred to and processed in the United States, which may have data protection laws different from those of your jurisdiction.
11. Changes to This Policy
We may update this Privacy Policy from time to time. If we make material changes, we will notify you (such as by email or an in-app notice) before the changes take effect. The “Last Updated” date at the top of this Policy reflects the most recent revision.
